By accessing or using Short.now ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time; continued use after changes constitutes acceptance.
2. Description of Service
Short.now is an AI-powered platform that processes video content to automatically generate short-form clips, captions, and related media for distribution on social platforms. Features and capabilities are subject to change without notice.
3. Eligibility
You must be at least 13 years old to use Short.now. By using the Service you represent that you are of legal age in your jurisdiction to form a binding contract. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
4. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for losses arising from unauthorized account access caused by your failure to safeguard your credentials.
5. Content and Intellectual Property
Your content
You retain all ownership rights to the videos and media you upload ("Your Content"). By uploading content, you grant Short.now a limited, non-exclusive, royalty-free license to process, transcode, and store Your Content solely to provide the Service to you.
Your representations
You represent and warrant that:
- You own or have the necessary rights to upload and process Your Content
- Your Content does not infringe any third-party intellectual property rights
- Your Content complies with all applicable laws and these Terms
- You have obtained all necessary permissions for any persons depicted in Your Content
Our intellectual property
Short.now and its licensors own all rights to the Service, including the software, AI models, design, and branding. Nothing in these Terms grants you rights to our intellectual property beyond the limited right to use the Service.
6. Prohibited Uses
You agree not to use the Service to:
- Upload content that infringes copyright, trademarks, or other intellectual property
- Upload illegal, harmful, defamatory, obscene, or harassing content
- Attempt to reverse-engineer, decompile, or extract our AI models
- Circumvent usage limits or access controls
- Use automated scripts to access the Service beyond our documented API
- Resell or sublicense the Service without our written consent
7. Subscriptions and Billing
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.
8. Free Plan
The free Starter plan is provided "as is" and may be modified or discontinued at any time. Free plan features and limits are subject to change without notice.
9. Termination
Either party may terminate at any time. We may suspend or terminate your account immediately for violation of these Terms. Upon termination, your right to use the Service ceases and we may delete Your Content after a reasonable notice period.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHORT.NOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved in the competent courts of the jurisdiction in which Short.now is incorporated.
